Can new FDA graphic warning labels for tobacco pass a first amendment legal challenge?

When the U.S. Food and Drug Administration (FDA) imposes new graphic warning labels for tobacco products, they can survive a First Amendment challenge if they depict health consequences and their effectiveness is supported by adequate scientific evidence, says a Georgetown University Medical Center public health expert and attorney.

Do diet changes help ADHD children?

Dylan Jerrell was having a tough time in kindergarten. The energetic, outgoing Bigfoot fan was easily frustrated, and he responded to challenges with disruptive meltdowns. He wouldn't hit anyone, but he'd break down and cry or yell at his teachers. For a week in mid-September, he was in the principal's office every single day. His mom, Jacqueline Fellows, considered home schooling. His pediatrician offered medication for attention deficit hyperactivity disorder.

(HealthDay News) —The U.S. Supreme Court on Monday rejected a tobacco industry challenge to a controversial 2009 federal law that mandates graphic warning labels on cigarettes.
Study: Graphic warnings on cigarettes effective across demographic groups

Quitting smoking is a common New Year's resolution for Americans each year, but research has repeatedly shown it is not an easy task. Some groups, such as racial/ethnic minorities, have an even harder time quitting. New research suggests hard-hitting graphic tobacco warnings may help smokers of diverse backgrounds who are struggling to quit. A new study by researchers at Legacy® and Harvard School of Public Health provides further evidence that bold pictorial cigarette warning labels that visually depict the health consequences of smoking—such as those required under the 2009 Family Smoking and Prevention Tobacco Control Act—play a life-saving role in highlighting the dangers of smoking and encouraging smokers to quit.

(Medical Xpress)—Health warning labels have adorned cigarette packages since 1966, when they first appeared in the United States.
Pictures effective in warning against cigarette smoking, study shows

Health warning labels (HWLs) on cigarette packages that use pictures to show the health consequences of smoking are effective in reaching adult smokers, according to the results of a new study published in the December issue of the American Journal of Preventive Medicine. Although previous studies have demonstrated that HWLs with pictorial imagery are more effective than HWLs with only text in increasing knowledge about smoking dangers and promoting the benefits of quitting, this new research shows which kind of pictures appears to work best among adult smokers in the U.S., including smokers from disadvantaged groups where smoking rates are highest.

Injuries, manufacturer warnings do not deter ATV use by children under age 16

All-terrain vehicle (ATV) manufacturer warning labels aimed at children under age 16 are largely ineffective, and formal dealer-sponsored training is infrequently offered and deemed unnecessary by most young ATV users, according to new research presented at the Oct. 22 at the American Academy of Pediatrics (AAP) National Conference and Exhibition in New Orleans. The study of ATV crashes involving children also found less than 35 percent of children were wearing a helmet when injured in an ATV crash, and nearly 60 percent were riding again within six months.

First universal standards guiding content, appearance of prescription container labels

With medication misuse resulting in more than one million adverse drug events per year in the United States, new standards released today by the U.S. Pharmacopeial Convention (USP) for the first time provide a universal approach to the format, appearance, content and language of instructions for medicines in containers dispensed by pharmacists. Wide variability in prescription container labels exists today across individual prescriptions, pharmacies, retail chains and states. The USP standards provide specific direction on how to organize labels in a "patient-centered" manner that best reflects how most patients seek out and understand medication instructions.
